User Agreement

Introduction  

Progress Lifeline is a trading name of Progress Housing Group. Use of this website and the services provided via it ("www.progresslifeline.org.uk") are conditional upon you accepting the following terms and conditions.  Unless otherwise specified, your acceptance of this User Agreement shall be indicated by your use of and/or registration with www.progresslifeline.org.uk.  www.progresslifeline.org.uk is provided by Progress Housing Group and its suppliers ("we"/"our"/"us").

These terms and conditions and our Privacy Policy (together the “User Agreement”) form our entire agreement with you in respect of non-chargeable use of www.progressgroup.org.uk and supersede any prior agreement or arrangement with you in respect of www.progresslifeline.org.uk.  If a company name is inserted in your registration request, then the User Agreement shall be between us and that company and accordingly unless the context otherwise requires, references to "you" and "your" in this User Agreement shall also be to that company.  The purchase of [goods/services] from us is subject to our Terms and Conditions of Purchase.  If there are any updates to this User Agreement or to the Terms and Conditions of Purchase, we will bring this to your attention on the home page of www.progresslifeline.org.uk.

Availability of www.progresslifeline.org.uk

We will endeavour to ensure that www.progresslifeline.org.uk is available 24 hours per day without any interruptions.  However, we reserve the right to make www.progresslifeline.org.uk unavailable at any time or to restrict access to parts or all of www.progresslifeline.org.uk without notice.  www.progresslifeline.org.uk is a general information service.  We will endeavour not to make it misleading, but we  cannot represent that the information accessible on or via www.progresslifeline.org.uk is accurate, not-misleading, complete or up to date.

Intellectual property 

www.progressgroup.org.uk, its style and structure, and the materials and information on www.progresslifeline.org.uk are protected by copyright and other intellectual property rights, and may not be used by you except as expressly provided in this User Agreement.  The authors of the documents in www.progresslifeline.org.uk assert their moral rights.

Our Liability 

Since a substantial part of www.progresslifeline.org.uk is both free and available to all, it is a condition that your use of www.progresslifeline.org.uk is at your own risk.  We shall not be liable to you or in breach of this User Agreement for any delay or failure to perform any obligation if the delay or failure is due to a cause beyond our reasonable control including, without limitation, the blocking or restricting of information to and/or from our network.

Except as expressly provided in this User agreement, we disclaim any further representations, warranties, conditions or other terms, express or implied, by statute, collaterally or otherwise, including but not limited to implied warranties, conditions or other terms of satisfactory quality, fitness for a particular purpose or reasonable care and skill.

Save as provided below, we disclaim all and will not be liable in contract, tort (including, without limitation, negligence) or otherwise arising in connection with this User Agreement or the www.progresslifeline.org.uk for: (i) consequential, indirect or special loss or damage; or (ii) any loss of goodwill or reputation; or (iii) any economic losses (including loss of revenues, profits, contracts, business or anticipated savings), in each case, even if we have been advised of the possibility of such loss or damage and howsoever incurred.

Small Print  

Either of us may terminate this User Agreement at any time.  You may not transfer any of your rights or delegate any of your obligations under this User Agreement without our prior written consent.  If we fail to enforce any provision of this User Agreement, that failure will not preclude us from enforcing either that provision (or any similar provision) on a later occasion.  Nothing in this User Agreement shall confer on any third party any benefit or the right to enforce any term of the User Agreement. This User Agreement is governed by English law and any dispute connected with this agreement is subject to the exclusive jurisdiction of the English courts.  Nothing in this User Agreement affects your statutory rights as a consumer. 

Complaints

Web chat and email 

www.progresslifeline.org.uk offers a web chat service which is managed by Progress Housing Group. Progress Housing Group makes every effort to ensure the security and integrity of web chat and email on our systems. Unfortunately, no data transmission over the internet can be guaranteed to be 100 per cent secure. As a result, while we strive to protect your personal information after we have received it, Progress Housing Group cannot ensure or guarantee the security of information when it is being transmitted.

We record our web chats with you. Any information that we record may then be used for training purposes, quality assurance, to record details about the products and services you order from us, and in order to meet our legal and regulatory obligations. Please note, as is standard with live chat software, our operators can see what a customer engaged in a chat is typing in real-time, prior to submission by clicking send. This enables our operators to have responses ready quickly - especially for lengthier customer questions.  

By recording web chats, we can improve the quality of service we provide and improve the way we deal with complaints.

Privacy

Progress Housing Group is committed to protecting your privacy. Progress Housing Group knows that you care how information about you is used and appreciates your trust in it to do that carefully and sensibly. At times you will be asked to submit personal information about yourself (name, email address, postcode etc.). By entering your details in the fields as requested you enable Progress Housing Group to provide you with the services you select. Whenever you provide such personal information, Progress Housing Group will treat that information in accordance with this notice and policy. All email correspondence includes instructions on how to ‘unsubscribe’ from the service to which you have subscribed. Our services are designed to give you the information that you want to receive not to bombard you with information you do not want. Hotjar uses cookies and other technologies to collect data on our users’ behaviour and their devices (in particular device's IP address (captured and stored only in anonymized form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), preferred language used to display our website). Hotjar stores this information in a pseudonymized user profile. Neither Hotjar nor we will ever use this information to identify individual users or to match it with further data on an individual user.
